Terms of Service for My Mechanics, LLC

Effective Date: 1/15/2025

Welcome to My Mechanics LLC! These Terms of Service (“Terms”) govern your use of the My Mechanics LLC platform (“Platform”), including the website, mobile application, and related services provided by My Mechanics LLC (“Company,” “we,” “us,” or “our”). By accessing or using our Platform, you agree to these Terms. If you do not agree, do not use the Platform.

1. Services Provided

My Mechanics connects customers (“Customers”) with independent, third-party mechanics (“Mechanics”) for vehicle maintenance and repair services. We are not a repair shop and do not directly provide mechanic services.

Mechanics operate as independent contractors, not employees or agents of My Mechanic. The Company acts solely as a platform provider to facilitate connections and transactions.

2. Eligibility

To use the Platform, you must:

a. Be at least 18 years old.

b. Agree to provide accurate and complete information during registration.

c. Use the Platform in compliance with applicable laws.

3. Account Registration

Users must create an account to access the Platform. You are responsible for safeguarding your login credentials and for any activity under your account. Notify us immediately of unauthorized access or security breaches.

4. Payments

My Mechanics LLC employs the use of Electronic Signatures for authorization and approval of all its automotive mobile repair services. By checking the “I Agree" to  the terms of services, and/or the "I Authorize" check box you are electronically signing an E-Sign Agreement and the Terms related to the services. Any signature (including any electronic symbol or process attached to, or associated with, a contract or other record and adopted by a Person with the intent to sign, authenticate or accept such contract or record) hereto or to any other certificate, agreement or document related to this transaction, user agrees, and acknowledges that it is such party’s intent, that if such party signs any Agreement (or, if applicable, such closing document) using an electronic signature, it is signing, adopting, and accepting this Agreement or such closing document and that signing this Agreement or such closing document using an electronic signature is the legal equivalent of having placed its handwritten signature on this Agreement or such closing document on paper. The use of electronic signatures and electronic records (including, without limitation, any contract or other record created, generated, sent, communicated, received, or stored by electronic means) shall be of the same legal effect, validity and enforceability as a manually executed signature or use of a paper-based record-keeping system to the fullest extent permitted by applicable law, including the Federal Electronic Signatures in Global and National Commerce Act, the New York State Electronic Signatures and Records Act and any other applicable law, including, without limitation, any state law based on the Uniform Electronic Transactions Act or the Uniform Commercial Code.

My Mechanics LLC DOES NOT ACCEPT, RECOGNIZE, OR APPROVE CASH TRANSACTIONS. ALL TRANSACTIONS ARE REQUIRED TO BE MADE VIA THE INVOICE SENT BY MY MECHANICS LLC, INCLUDING TIPS. All mechanics authorized to serve customers derived from this platform are prohibited from taking cash payments and/or side deals or transactions under penalty of Breach of Contract. Customers/Users that paid or compensated any "My Mechanics" mobile mechanic outside of the app's designated payment services immediately forfeit their right(s) to claim any warranties, seek any legal action, and/or be compensated by My Mechanics LLC for past, current, and future automotive mechanic, cosmetic, electrical issues, or other complications that may directly or indirectly related to any automotive repairs that may have been rendered as a result of said mechanic that claimed association with the My Mechanics LLC platform. By way of consumer protection advice, My Mechanics LLC strongly discourages cash transactions with any mobile mechanic as a measure of fraud prevention.

You agree to pay all fees charged to your account based on My Mechanics LLC’s fees, charges, and billing terms shown in your account. You are also responsible for paying any sales and use taxes and shipping and handling fees that may apply to the purchase of services, and you authorize My Mechanics LLC, or the third party payment processing service provider that we engage, to charge your credit card for any such taxes and fees. All payments shall be made by credit card in advance prior to shipping any Products or performance of any services. If you can not pay on time or if your credit card cannot be charged for any reason, My Mechanics LLC reserves the right to withhold performing the agreed services until payment is rendered in full according to these Terms of Service. All sales and payments are final and are paid in US Dollars.

5. Independent Contractor Relationship

Mechanics are not employees, agents, or representatives of the Company. The Company does not:

a. Control how Mechanics perform their work.

b. Guarantee the quality, safety, or legality of services provided.

Disputes regarding services must be resolved directly between Customers and Mechanics.

6. Cancellations and Refunds

Customers may cancel a booking under the following conditions:

• Cancellations made within 24 hours before the scheduled appointment may incur a fee.

Refunds are handled case-by-case in compliance with our Refund Policy.

7. Prohibited Uses

You agree not to:

a. Use the Platform for unlawful purposes.

b. Impersonate another person or misrepresent your identity.

c. Interfere with the Platform’s operation or security.

8. Liability Disclaimer

My Mechanics LLC provides the Platform “as is” without warranties of any kind. We are not liable for:

a. The conduct of Mechanics or Customers.

b. Damages resulting from mechanic services.

c. Indirect, incidental, or consequential damages.

To the extent permitted by law, the Company’s total liability is limited to the fees paid by the Customer in the past 6 months.

9. Dispute Resolution

Disputes between Customers and Mechanics should be resolved directly. The Company may, at its discretion, assist in dispute resolution but is not obligated to mediate.

For disputes involving the Company, users agree to binding arbitration as outlined in our Arbitration Agreement.

10. Termination

We may suspend or terminate your access to the Platform at any time for violations of these Terms or other reasons at our discretion.

11. Privacy Policy

Your use of the Platform is subject to our Privacy Policy.

12. Modifications to Terms

We may update these Terms from time to time. Continued use of the Platform after updates constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of Hillsborough County within the state of Florida in the United States.
